Terms and conditions

1. Contractual information

The website (hereinafter referred to as the "Site", "Shop" or "IONEX d.o.o.") is operated in Slovenia by IONEX d.o.o., Slomškova 25, SI - 1000 Ljubljana, Slovenia; VAT ID: SI36551058. The company acts as an e-commerce service provider (hereinafter referred to as "the Provider"). To contact us, please fill in the contact form.

When registering in the IONEX d.o.o. system (www.ionex.si), the visitor receives a username - which is identical to his/her e-mail address - and a password. Registration on the site is not a prerequisite for purchasing products - quick purchase without logging in is also available. The General Terms and Conditions of Business deal with the operation of the IONEX d.o.o. website (www.ionex.si), the rights of the user and the business relationship between the provider and the buyer or visitor to the website.

2. Information required before shopping on the website

All products contain information on their features, price (including VAT), shipping costs and right of withdrawal. We deliver by DPD courier and standard post, depending on the country of delivery. Information on the shipping price and the delivery provider is provided when placing the order.

3. Products

Due to the nature of doing business online, the offer of IONEX d.o.o. (www.ionex.si) is updated and changes frequently and quickly. Prices are presented as Regular Prices and Online Prices. Regular prices are the manufacturer's or importer's recommended retail prices or the prices established by the supplier. The Online Price is the price applicable in the case of purchase of the product through the IONEX d.o.o. website (www.ionex.si). Reduced prices apply when and for those items where this is expressly stated.

4. Purchase procedure

On the IONEX d.o.o. website (www.ionex.si), the purchase process is carried out in the following simple steps:

  1. Order accepted: after placing the order, the customer receives an email notification that the order has been accepted. If the Buyer wishes to cancel the order, he/she may do so within one hour of placing the order by notifying us in writing by email - ionex@www.ionex.si (as long as the order status is 'Pending').
  2. Order confirmed: if the buyer does not cancel the order, the order goes to further processing, when the provider reviews the order, checks the deliverability of the ordered items and confirms or rejects the order with a reason. The Supplier may call the Buyer's contact telephone number to verify the details or to ensure the accuracy of the delivery. Upon confirmation of the order, the order shall be given the status 'Confirmed', 'Processing' or 'Processed'. The Provider shall inform the Buyer by e-mail of the estimated delivery time. The contract for the purchase of the ordered items between the Buyer and the Provider is irrevocably concluded at this stage.
  3. Goods dispatched: the Supplier prepares and dispatches the goods within the agreed deadline, notifying the Buyer by email (order status is 'Sent' or 'Shipped'. The Buyer has the right to reject the goods in accordance with the legal provisions and the terms and conditions of IONEX d.o.o. (www.ionex.si).
  4. The customer receives the original invoice together with the product ordered or by e-mail to the address recorded when registering on our website.

5. Payment terms

5.1 Conclusion of the contract

We issue a written invoice to the user who purchases the product. The purchase contract in the form of an online order is stored electronically on our server.

By clicking on the 'Place Order' button, you agree that you have placed an order and acknowledge that payment is due. From that moment on, all prices and other terms and conditions of purchase are fixed and apply to both us and the user (buyer).

Under the Code of Obligations, the buyer is obliged to take delivery of the ordered package and pay the redemption fee. If the ordered goods are refused or not collected, the postage and return costs shall be borne by the Customer. The invoice for the shipping costs will be given to our partner company for execution or collection.

If the buyer wishes to withdraw from the contract without giving a reason for a distance purchase (via the online shop), he/she must inform us in writing (by e-mail to ionex@www.ionex.si) within 14 days that he/she is withdrawing from the contract. Mere failure to accept the package does not constitute a withdrawal from the contract, it must be notified in writing within the time limit! However, shipping costs incurred are not refundable under the Consumer Protection Act.

If the goods have not been ordered by the person named in the data, we will consider this to be a misuse of personal data and will refer the matter to the law enforcement authorities. All data will be handed over, including the IP number of the computer from which the order was placed.

Any additional charges (such as fees for using cards or other payment methods), if applicable, will be explicitly mentioned. You must explicitly agree to any additional charges for additional services. In general, we do not charge surcharges for any payment method unless explicitly stated.

5.2 Payment methods

On the IONEX d.o.o. website (www.ionex.si) we offer the following payment methods:

  • online payment with PayPal - our account is ionex@www.ionex.si
  • online payment with credit or debit cards Visa, Mastercard, Visa Electron, Maestro via PayMill
  • by bank transfer to the IONEX d.o.o. account according to the offer/invoice (The online price is plus the cost of postage). Our bank details: IONEX d.o.o., Slomškova 25, 1000 Ljubljana.   • by ransom - via DPD courier service (the online price plus the shipping costs). Payment to the courier can be made by cash. To pay by cash on delivery by bank card, payment is only possible if you have provided your email address when ordering. Payment is made via a secure payment interface in time for the courier to deliver the package to you. You can access the payment interface via the link you received in the expected shipment notification email sent to you by the DPD courier service. In the event that, at your request, the courier leave it at the Petrol d.d. service station nearest you., Petrol d.d. will charge the final recipient a fee of EUR 0.30 (incl. VAT) for the service of delivery and EUR 0.85 (incl. VAT) for the processing of the redemption (if payment is made in cash or by card) as from 01.04.2019. Example: you have ordered on cash on delivery and wish to pay by card, you can subsequently choose to pick up your package at a Petrol service station. The shipping cost will be: €4 + €0.30 + €0.85 = €5.15.
  • by cash, debit (Maestro, Activa) or credit cards (Mastercard, Visa, Karanta) upon personal collection at the online shop's location at IONEX d.o.o., Slomškova 25, 1000 Ljubljana.

5.3 Price discrimination

As an EU national, you cannot be charged a higher price for goods or services because of your nationality or country of residence. Some prices only differ if there is an objective criterion that does not depend on nationality, such as the cost of shipping.

5.3 VAT accounting

As a general rule, consumers pay VAT only once when they buy on the EU market, at the rate of the country where they made the purchase. The general rate of VAT in Slovenia is 22%, while for books it is 9,50%.

However, special rules may apply when you buy goods from another EU country for delivery to your country of residence. If the company you are buying from sells goods above a certain value to your country of delivery, it cannot charge the VAT of the country where the purchase was made. Instead, they must charge the VAT of the country where the goods are delivered - the VAT of the place of destination. The overall cap for cross-border sales is set by each EU country and is set at €35,000 or €100,000. This means that most major online retailers supplying in the EU will have to apply the VAT of the destination rule.

VAT is deducted on supplies to countries outside the EU.

5.4 Prices

The online price is valid for all visitors to the IONEX d.o.o. website (www.ionex.si). Registration in the system is not a condition for purchasing in the online shop and is not a condition for purchasing at the online price. All prices include VAT, unless explicitly stated otherwise. Prices are valid at the time of placing the order and have no predefined validity. Prices are valid in the case of payment by all payment methods offered by the website, subject to the General Terms and Conditions.

Despite our best efforts to provide the most up-to-date and accurate information, it is possible that a price may be incorrect. In this case, or in the event that the price of the item changes during the processing of the order, the Provider will allow the Buyer to withdraw from the purchase and the Provider will offer the Buyer a mutually satisfactory solution. The purchase contract between the Provider and the Buyer is concluded at the moment when the Provider confirms the order (the Buyer receives an e-mail with the status Order Confirmed). From that moment on, all prices and other conditions are fixed and apply to both the Provider and the Buyer.

5.5 Purchase security

For your security, we will never ask you for your bank details or account number in the IONEX d.o.o. online shop (www.ionex.si). We only need your address to pay by invoice in advance or cash on delivery. Payment by debit or credit card in the PayMill system (https://www.paymill.com) or Paypal (https://www.paypal.com/si/home) is processed through the systems of these companies, which also ensure the security of the transactions and guarantee the safety of the purchase. This is how we have ensured that your purchase at the IONEX d.o.o. online shop (www.ionex.si) is completely secure.

6. Delivery

All products include information on delivery costs. This is shown when you place your order and select your preferred delivery method.

The tenderer will deliver the goods or services within the agreed timeframe. The contractual partner for the delivery of the consignments shall be the courier service DPD, but the tenderer reserves the right to choose another delivery service if this will enable the order to be fulfilled more efficiently. Products in stock will be delivered within 1 to 3 working days from the date of final confirmation of your order.

Delivery of products is charged according to the following price list:

- The general delivery charge in Slovenia, regardless of weight, total value or place of delivery, is € 4.00 (VAT included).

- In case of a special promotion, no postage is charged (postage paid by IONEX d.o.o. (www.ionex.si))

- In case of shipping outside Slovenia, postage will be charged according to the weight - please send your enquiry by e-mail to ionex@www.ionex.si.

6.1 Shipment tracking

Yes, you can track your shipments. Enter your parcel number in the online tracking portal belonging to the relevant tracking delivery service provider. At Post Slovenije, only registered parcels can be tracked, not ordinary parcels.

6.2 Delivery times

They depend on the time of year and road conditions. Generally, you should receive your goods within 1-2 days by DPD courier. Deliveries are usually made between 8am and 4pm Monday to Friday. There are no deliveries on public holidays, weekends or public holidays.

You will receive an email or SMS to let you know when your package is expected to be delivered. If there are any changes to the delivery, we will inform you in good time at the contact number or email address you gave us when you placed your order.

If you are not at home/work at the time of the courier's arrival, the courier will leave a delivery failure note. Please call the number on the notification to arrange a redelivery. We will normally give your contact number to the courier, unless you specifically object, so that they can call you before delivery if necessary to arrange an appointment. Please let us know if you will be unable to collect your parcel for a long period of time.

8. Warranty

Items come with a guarantee. Warranty periods are stated on the warranty card, in the instructions or on the invoice. The warranty is valid subject to the instructions on the warranty card and the presentation of the invoice. Consumers may request repair or free replacement if repair is not possible. We will replace the item within a reasonable time. If the product has been used in contravention of its instructions for use or is damaged and the customer is responsible for the damage, the warranty will be void. 10. Right to equal contractual terms

Every consumer in the EU is protected from unfair standard contract terms that create unreasonable imbalances to the detriment of the consumer. This also applies to the digital environment.

11. Communication

The Provider will contact the User by means of distance communication in connection with the order, unless the User expressly objects to this.

However, in the case of promotional emails or newsletters, the provider will only contact the user if the user explicitly consents to such communication. Such advertising messages will contain the following elements:

- will be marked as advertising messages or news or as IONEX d.o.o. news (www.ionex.si),
- the sender - IONEX d.o.o. (www.ionex.si) - will be clearly visible,
- various campaigns, promotions and other marketing techniques will be labelled as such. The conditions for participation in them will also be clearly defined,
- a clear explanation of how to opt-out of receiving advertising messages.

The Provider will expressly respect the user's wish not to receive advertising messages and will immediately remove the user from the newsletter mailing list.

12. Disclaimer

The Provider shall use its best endeavours to ensure that the information published on its website is up-to-date and correct. However, due to the nature of e-commerce, the characteristics of the items, the delivery date or the price may change so quickly that the provider is unable to correct the information on the website. In such a case, the provider will inform the buyer of the changes and give him the opportunity to cancel the order or to exchange the item ordered. The supplier endeavours to provide accurate photographs of the items sold, but there may be differences in the colour of the product.

13. Protection of personal data

The Provider undertakes to permanently protect all personal data of the User in accordance with the latest legislation (GDPR). The Provider will use the personal data exclusively for the purpose of fulfilling the order (sending informative material, offers, invoices) and other necessary communication. Under no circumstances will the user's data be passed on to unauthorised persons. The user is responsible for the protection of his/her personal data by ensuring the security of his/her username and password and by using appropriate software (anti-virus) to protect his/her computer.

13. Complaints and disputes

The Provider complies with applicable consumer protection legislation. The Provider shall endeavour to comply with its obligation to have in place an effective complaints handling system and to designate a person whom (in the event of a problem) the Customer may contact by telephone or email. A complaint should be made via the email address ionex@www.ionex.si. The complaint handling process is confidential.
